Terms & Conditions

1. Apogee Services Pty. Ltd. Terms & Conditions override any other terms & conditions and / or client terms & conditions.
2. By default the client agrees in full to Apogee Services Pty. Ltd. terms & conditions.
3. Apogee Services Pty. Ltd. Terms & Conditions are subject to change without notice.
4. Apogee Services Pty. Ltd. reserves the right to apply any decision by Apogee Services Pty. Ltd. on their sole discretion as an acceptable addition to the terms & condition.
5. Apogee Services Pty. Ltd. decision / directives are final.
6. Any client disputes or application of alteration to Apogee Services Pty. Ltd. terms & conditions are to be provided by the client prior to work commencing, in the form of written advice within a suitable time at the sole discretion of Apogee Services Pty. Ltd. & have written acceptance / conformation by Apogee Services Pty. Ltd. in reply.
7. Apogee Services Pty. Ltd. for the purpose of "Apogee Services Terms & Conditions" will regard the "client" as the company / entity / individual or their representatives whom engage the services of Apogee Services Pty. Ltd. or approach / lobby / instruct Apogee Services Pty. Ltd. in any format, verbal, written, electronically or any other medium acceptable to Apogee Services Pty. Ltd. when the client performs any of these actions they are assumed by Apogee Services Pty. Ltd. to have agreed and / or stated they will comply in full with Apogee Services Pty. Ltd. Terms & Conditions by default. Apogee Services Pty. Ltd will in all cases upon request by the client provide the terms & conditions prior, in written or verbal advice. It is elective for the client to obtain / understand and not the responsibility of Apogee Services Pty. Ltd.
8. The "Client" is responsible for compliance in full to Apogee Services Pty. Ltd. terms & conditions and is responsible for all penalties & costs at Apogee Services Pty. Ltd. sole discretion.
9. The title of the client / client representative will appear on all invoices, this is the offered / supplied identity of the client by the client & no redirecting of accounts / correspondence to any third parties will be permitted by Apogee Services Pty. Ltd. without written acceptance and subsequent written conformation by Apogee Services Pty. Ltd.
10. The client is to provide at all times for Apogee Services Pty. Ltd. And it representatives / associates a safe / secure / non threatening work site at the sole discretion of Apogee Services Pty. Ltd. The client is responsible in full where this does not occur & are responsible for any subsequent fees, penalties, charges, expenses, legal directives at Apogee Services Pty. Ltd. sole discretion.
11. Apogee Services Pty. Ltd at their sole discretion will determine acceptable account terms & the client it to adhere to these terms without exception. These account terms are subject to change without notice.
12. Apogee Services Pty. Ltd at their sole discretion will determine when progress claims will be made. Apogee Services Pty. Ltd. at their sole discretion will determine if a project will a have a claim made prior to completion. The amount of the progress claim at the sole discretion of Apogee Services Pty. Ltd.
13. Apogee Services Pty. Ltd. accepts no responsibility for compliance / adherence of any clients order system / variations or authorization system that is not complied with or has been incorrectly applied for the purpose of engaging Apogee Services Pty. Ltd. It is the responsibility of the client prior to engaging Apogee Services Pty. Ltd. to advise Apogee Services Pty. Ltd of any such systems / directives in writing & have written acceptance / conformation by Apogee Services Pty. Ltd. in reply prior to this eventuality.
14. The client agrees to have engaged the services of Apogee Services Pty. Ltd in the capacity of electrical installer / repairer, service provider only. Any other capacity must be requested by the client to Apogee Services Pty. Ltd & have written acceptance / conformation by Apogee Services Pty. Ltd. in reply.
15. Apogee Services Pty. Ltd. will use, at their sole discretion, a standard range of products any alternatives must be requested by the client to Apogee Services Pty. Ltd & have written acceptance / conformation by Apogee Services Pty. Ltd in reply.
16. All proposals / quotes / invoices / non-compliance reports / any other correspondence / outcomes / advice / recommendations may be based on information supplied by the client / client's representative / supply authority / sub contractor. Apogee Services Pty. Ltd. accepts no responsibility or compliance for the accuracy / authority of this information and / or the clients understanding / opinion / interpretation of the aforementioned and any subsequent costs / charges / expenses / penalties that may arise as a result. Apogee Services reserves the right to charge additional costs in these cases where the information is wrong / insufficient / not clear / interpreted differently / not provided in writing or supplied at a suitable time frame, at the sole discretion of Apogee Services Pty. Ltd. & have written acceptance / conformation by Apogee Services Pty. Ltd. in reply.
17. The views & advice of representatives of Apogee Services Pty. Ltd are not necessarily the views / advice of Apogee Services Pty. Ltd.
18. Directives / quotes / estimates / "Do & Charge" work / advice / etc. are offered by Apogee Services Pty. Ltd. in good faith & there are instances where such works are based on information provided by the client / clients representative / supply authority / sub contractors. Apogee Services Pty. Ltd. accepts no responsibility or compliance for the accuracy / authority of this information and / or the clients understanding / opinion / interpretation of the aforementioned and any subsequent costs / charges / expenses / penalties that may arise as a result. Apogee Services reserves the right to charge additional costs in these cases where the information is wrong / insufficient / interpreted differently / non-compliant / found to be non-compliant at a later date / not clear or not provided in writing at a suitable time at the sole discretion of Apogee Services Pty. Ltd. & have written acceptance / conformation by Apogee Services Pty. Ltd. in reply
19. Apogee Services Pty. Ltd will / may charge late fees / interest / administration fees for all invoices / invoice alterations / overdue accounts at the sole discretion of Apogee Services Pty. Ltd. The amount and information relating to the application of which are available by request by the client. By default the client will not be supplied this information without Apogee Services Pty. Ltd. being requested by the client in writing for it prior to engaging the services of Apogee Services Pty. Ltd .
20. The client agrees to pay all fees / charges / accounts / interest / penalties requested by Apogee Services Pty. Ltd. when requested by Apogee Services Pty. Ltd.
21. The client is to ensure all outstanding monies are to be paid to Apogee Services Pty. Ltd. prior to the due date & have written acceptance / conformation by Apogee Services Pty. Ltd in reply.
22. The client is to ensure all / any account queries are submitted in writing & received by Apogee Service Pty. Ltd prior to the due date. Queries received outside of the due dates will be refused at the sole discretion of Apogee Services Pty. Ltd. Therefore considered to be an account outside of Apogee Services Pty. Ltd. trading terms, penalties will apply.
23. Apogee Services Pty. Ltd. will not accept monies being withheld due to a disputed account outside the nominated trading terms / due date. If this occurs account will be considered outside of trading terms, penalties will apply.
24. Accounts outside trading terms / overdue will be charged additional fees / charges / interest / penalties at the sole discretion of Apogee Services Pty. Ltd. (see Apogee Services Pty. Ltd. fees & charges)
25. Apogee Services Pty. Ltd. reserves the right to utilize any collection agency / service / collection method for due accounts & overdue accounts at the sole discretion of Apogee Services Pty. Ltd.
26. Apogee Services Pty. Ltd accepts no responsibility for any clients or clients associates costs incurred where as a result late payment / overdue payment or any other event at the sole discretion of Apogee Services Pty. Ltd. has resulted in Apogee Services Pty. Ltd exercising its right to stop work / delay work / remove materials not paid in full, even if regarded as fixtures / engage legal services / lock down site / seek a level of compensation the value of which is at the sole discretion of Apogee Services Pty. Ltd.
27. Apogee Services Pty. Ltd. accepts no responsibility for unauthorized work / non compliant work with any site covenant or site specific rules / codes / policies / zoning / standards.
28. Unless written acceptance / conformation by Apogee Services Pty. Ltd. Has been supplied to the client by Apogee Services Pty. Ltd. all quotes / proposals / other works exclude any site specific safety / induction costs / actions / charges. As a result these will be additional charges at the sole discretion of Apogee Services Pty. Ltd.
29. All quotes / proposals / other works are based on sufficient and safe access within structures / cabinets / enclosures, where this does not occur, additional charges at the sole discretion of Apogee Services Pty. Ltd. will apply.
30. All quotes / proposals / works are based on existing structures / cabinets / enclosures / wiring systems to be located within a reasonable distance form location of works at the sole discretion of Apogee Services Pty. Ltd. where this does not occur, additional charges at the sole discretion of Apogee Services Pty. Ltd. will apply.
31. All quotes / proposals / works are based on existing structures / cabinets / enclosures / wiring systems to be in good order, well maintained and correctly installed at the sole discretion of Apogee Services Pty. Ltd. where this does not occur, additional charges at the sole discretion of Apogee Services Pty. Ltd. will apply for any costs incurred to resolve.
32. The client is to advise Apogee Services Pty. Ltd. of any hazardous zoning & have written acceptance / conformation by Apogee Services Pty. Ltd. in reply.
33. The client is to advise Apogee Services Pty. Ltd. of any Australian Standard (other than AS 3000) or any other compliance requirement & have written acceptance / conformation by Apogee Services Pty. Ltd. in reply. The client is responsible in full for advanced notification to Apogee Services Pty. Ltd. Where other compliances are required & have written acceptance / conformation by Apogee Services Pty. Ltd. in reply.
34. Apogee Services bears no responsibility for any deadlines / timeframes / targets not being met and therefore bears no financial responsibility for any costs incurred by these matters by the client / associates / clients representatives or sub contractors. Apogee Services may provide acknowledgement of client's deadlines / timeframes / targets, without accepting compliance to these targets unless the client has been provided written acceptance / conformation by Apogee Services Pty. Ltd. in reply.
35. Apogee Services Pty. Ltd. at their sole discretion may perform work / repairs / isolation for electrical safety. This work will be at additional charge to the client & the client authorizes in all cases in advance for Apogee Services Pty. Ltd. This authority.
36. Trenching or excavation is excluded form all proposals / quotes / works as default unless noted otherwise. Repairs required as a result of trenching or excavations are the responsibility of the client & in all cases excluded from all proposals / quotes / works as default.
37. Any rectifications / painting / restoration as a result of works by Apogee Services Pty. Ltd. Excluded from proposals / quotes / works.
38. Surface wiring may be installed at the sole discretion of Apogee Services Pty. Ltd.
39. Roofing material may be lifted at the sole discretion of Apogee Services Pty. Ltd.
40. The client indemnifies / excludes Apogee Services Pty. Ltd. from any claims / costs of any nature.
41. Previous repairs / fault finding may not be included in any proposals / quotes the client is to confirm / request if this is applicable at the sole discretion of Apogee Services Pty. Ltd.
42. Any information / proposals / quotes / works provided remote from work site will be subject to on site conformation.
43. Requests for itemized proposal / quotes will be declined in all cases.
44. All information obtained / provided by Apogee Services Pty. Ltd. remains the property of Apogee Services Pty. Ltd. & will only be disclosed at the sole discretion of Apogee Services Pty. Ltd. All such information forms intellectual property of Apogee Services Pty. Ltd. & therefore owned by Apogee Services, any unauthorized copying / reproduction of which will be subject to penalties at the sole discretion of Apogee Services Pty. Ltd.
45. Apogee Services Pty. Ltd. accepts no responsibility for any loss as a result of their actions. Financial loss / electrical supply loss / etc. At the sole discretion of Apogee Services Pty. Ltd.
46. Apogee Services Pty. Ltd. accepts no responsibility and / or reserves the right to apply additional costs for rectifications / alterations due to unusual / any event at the sole discretion of Apogee Services Pty. Ltd. (i.e. accumulative earth leakage currents, actual maximum demand exceeding calculated maximum demand, any existing electrical work that will compromise the performance of Apogee Services Pty. Ltd. work)
47. Client to perform their own due diligence in all cases. Client to satisfy their own legal / application compliance / equipment compliance / legal obligations in full.
48. Client responsible for compliance of all equipment / materials / directives supplied to or requested of Apogee Services Pty. Ltd. Apogee Services Pty. Ltd. accepts no responsibility for these items / issues or non-compliance / illegalities formed by these events.
49. Appropriate cancellation / deferment notification must be given to Apogee Services Pty. Ltd. Apogee Services Pty. Ltd. Reserves the right to charge additional fees / charges / interest / penalties at the sole discretion of Apogee Services Pty. Ltd.
50. Apogee Services Pty. Ltd. at their sole discretion will apply normal rates / overtime rates / penalty rates / other rates. A guide is available at request. A client should request in writing to Apogee Services Pty. Ltd & have written acceptance / conformation by Apogee Services Pty. Ltd. in reply to advise Apogee Services Pty. Ltd. if they wish to have a particular rate only applied.
51. Apogee Services Pty. Ltd. at their sole discretion will offer 12 month warranty on all workmanship. Apogee Services Pty. Ltd. at their sole discretion control where & when warranty on all workmanship will be conducted / performed. Apogee Services Pty. Ltd assumes no liability for any subsequent costs / charges / expenses / penalties that may arise as a result of a warranty claim.
52. Apogee Services Pty. Ltd. at their sole discretion will offer manufactures warranty only on all parts / materials supplied. Apogee Services Pty. Ltd. at their sole discretion control where & when warranties on all parts /materials will be conducted / performed. Apogee Services Pty. Ltd. assumes no liability for any subsequent costs / charges / expenses / penalties that may arise as a result of a warranty claim.
53. Apogee Services Pty. Ltd. at their sole discretion will charge additional fees / charges / interest / penalties on any event where Apogee Services Pty. Ltd. have had their work damaged, stolen, compromised by other parties. The client cannot engage the services of any third party to continue / complete / alter any work of Apogee Services Pty. Ltd. without providing written advise within a suitable time at the sole discretion of Apogee Services Pty. Ltd. & have written acceptance / conformation by Apogee Services Pty. Ltd. in reply.
54. Apogee Services Pty. Ltd accepts no responsibility for any non compliance issues this responsibility will be assumed by the "person in control" / "client". Any Client of Apogee Services Pty. Ltd cannot demand or claim control of Apogee Services Pty. Ltd. time / service levels / continuity of service. Apogee Services Pty. Ltd. is a contractor based service with response to safety for all its clients being the highest priority and therefore may impact on non safety related works being performed at any time. Apogee Services Pty. Ltd accepts no responsibility for any clients or clients associates costs incurred as a result.
